Rules of the Reichstag Act 2019
The Rules of the Reichstag Act was the first piece of legislation passed by the Reichstag. Its purpose is to outline, in detail, the procedures of the legislature, including how acts are passed, the duties of the President, and the rules that members are bound by.
The following law, having been approved by the nobles and right honourable citizens of the Imperial Diet on this day, is hereby enacted by the sovereign grace of Their Majesties.
1 - Title
1.1) The long title of this act is as follows: “For the purposes of establishing the rules of the Reichstag of the Austro-Hungarian Imperium, this Act is enacted.”
1.2) This act may further be referred to by its short title: “Rules of the Reichstag”
2 - The Reichstag and President
2.1) The Reichstag shall be the sole legislative assembly of the Austro-Hungarian Imperium. It shall serve a term of 60 days.
2.2) All official procedural business of the Reichstag shall be conducted on its designated forum, located at https://austriahungary.net/category/19/the-reichstag.
2.3) The Reichstag shall be led by the President of the Reichstag, referred to as the President within this Act, who shall serve until their resignation or end of the term of the Reichstag.
2.4) The President shall preside over all sessions of the Reichstag. The President shall facilitate all processes of the Reichstag, including but not limited to voting, debate, and motions. The President shall ensure that decorum is followed throughout these processes.
2.5) The President shall be elected by a majority of the members of the Reichstag immediately following the opening of the Reichstag by the Imperial Crown.
2.5.a) The Imperial Crown shall preside over all processes relating to the nomination and election of the President.
2.6) The President may designate a member of the Reichstag as president pro tempore to assume all duties of the President for no longer than 20 consecutive days.
2.7) Should the duties of the President not be exercised by the President or president pro tempore for 96 consecutive hours, the President shall be subject to automatic removal from office. The Imperial Crown will then preside over the selection of a new President as outlined in subsection 2.5.a of this Act.
2.8) The duties of the President shall be exercised in a manner not beholden to any partisan affiliation.
3 - Members of the Reichstag
3.1) There shall be no less than 3 elected members of the Reichstag, referred to as members within this Act, during a session, elected by the citizens of the Imperium on a ballot every 60 days unless otherwise that length should be adjusted by the Imperial Crown.
3.2) The Imperial Crown may appoint additional members to the Reichstag.
3.3) Members shall be entitled to vote on all bills and resolutions brought to a vote by the Reichstag.
3.4) Members shall be entitled to debate, in line with the provisions of this Act, legislation brought to the floor of the Reichstag.
3.5) Members shall be entitled to make motions on the floor provided another member seconds their motion within 36 hours of the motion being made.
3.6) Members shall be required to answer any questions addressed to them by citizens regarding legislation or their personal actions in the facilities outlined in Article 4 of this Act within 96 hours of inquiry.
3.7) Should a member not vote on 3 consecutive pieces of legislation, they will be removed from office following a writ of election being laid before the Council of State by the Imperial Crown on the advice of the President, and replaced according to Article III, subsection 2a of the Imperial Constitution.
4 - Facilities of the Reichstag
4.1) The facilities of the Reichstag shall be located at the web address listed in section 2.2 of this Act.
4.2) There shall be a subsection called “Office of the President” to be used for statements from the President.
4.3) There shall be a subsection called “Member Offices” to be used for statements from members.
4.3.a) Upon their assumption of the duties of a member, members who have not served in a previous session of the Reichstag shall create a thread within “Member Offices” titled “Office of [Member Name].” This thread shall be used for the purposes outlined in sections 3.6 and 4.3 of this Act.
4.4) There shall be a subsection called “Public Gallery” in which the President shall create a thread for every piece of legislation currently on the floor of the Reichstag for citizens to express their opinions in. Citizens may also submit legislation to be sponsored by members in this subsection.
4.5) There shall be a subsection called “Voting Lobby” in which the President shall create a thread for every piece of legislation currently scheduled to be voted upon for members to vote in.
4.6) There shall be a subsection called “Bill Submission” in which members may submit legislation to be numbered and introduced to the floor of the Reichstag by the President.
5 - Legislation and Debate
5.1) Legislation may be submitted to the Reichstag in the subsection detailed in section 4.6 of this Act.
5.2) Within 24 hours of the submission of a piece of legislation by a member according to section 5.1 of this Act, the President shall introduce the legislation to the chamber of the Reichstag after assigning the legislation a procedural number (e.g. Bill 1) and correcting any formatting and grammatical errors with the approval of the sponsor.
5.3) Upon the presentation of legislation to the Reichstag, the legislation will be open to debate on the floor. Any member shall be allowed to share their opinion and question other members during the debate period. The debate period shall last no longer than 2 weeks, however, members may motion to extend the debate period.
5.4) Members may motion to table (kill) a piece of legislation on the floor of the Reichstag no earlier than one week after the presentation of the legislation to the floor. After a motion to table has been seconded, members will have the next 24 hours to raise any objections. If no objections are raised, the legislation will be removed from the floor by the President and discarded.
6 - Voting
6.1) Members may motion to vote on a piece of legislation on the floor of the Reichstag no earlier than 72 hours after the presentation of the legislation to the floor.
6.2) After a motion to vote has been seconded, the President shall open a vote in the subsection outlined in section 4.5 of this Act. Members may vote on the legislation for 24 hours or until all members have voted. Members will be given the option to pass the legislation (“Aye”), fail the legislation (“No”), or refrain from expressing a preference (“Abstain”). Legislation, with the exception of Constitutional amendments, require a majority of votes (50% of “Ayes” and “Nos” plus one more in the affirmative) to pass.
6.3) Members may motion to pass legislation via a unanimous consent motion no earlier than one week after the presentation of the legislation to the floor. After a motion to pass via unanimous consent has been seconded, members will have the next 24 hours to raise any objections. If no objections are raised, the legislation will automatically be considered passed.
6.4) Members may propose amendments to modify legislation on the floor of the Reichstag. If they motion to vote on the amendment, the process to vote on the amendment will follow the process outlined in section 6.2 of this Act. If the amendment passes, the President will present the amended legislation to the floor of the Reichstag as a new piece of legislation with a new debate period.
7 - Conduct
7.1) Members shall follow this Act at all times during debate in the chamber and the Public Gallery subforum. Citizens offering their opinion on legislation shall follow the rules outlined in sections 7.3 through 7.5 of this Act when doing so in the Public Gallery subforum.
7.2) Members shall directly address the President, not other members, when debating legislation.
7.3) Members shall not personally insult each other when debating legislation.
7.4) Members shall not infringe upon the constitutional rights of other members or citizens.
7.5) Members shall not breach any other laws or guidelines, including any guidelines outlined by the Imperial Crown in relation to healthy offsite communication, during debate.
8 - Schedule
8.1) This Act shall go into effect immediately upon assent.
8.2) Upon the election of a new session of the Reichstag and the election of the President, members will be given the opportunity to amend this Act in the following 48 hours via resolutions of unanimous consent as outlined in section 6.3 of this Act.
